Adnan Subzwari recently secured another victory at the Ontario Court of Appeal, where the Court agreed that the claim against his client should be dismissed without a trial: Read the decision
The Court considered a claim that was issued by the plaintiffs in violation of a settlement agreement. Adnan defended his client in the Superior Court and secured a summary dismissal of the claim by operation of the terms of settlement. The Superior Court also awarded our client substantial indemnity costs.
On appeal, the panel upheld the Superior Court’s decision, finding the reasoning of the Judge to be “inescapable”.
