Litigation lawyers David Lees and Adnan Subzwari recently secured a major victory for their clients in the case of Mian et al, v. Mian et al. 2026 ONSC 5219 (CanLII) | Mian v. Mian | CanLII

The Court held the Plaintiff in contempt of court for breaching two court orders, and found that his conduct amounted to an abuse of process. The Court made a rare finding that where a Plaintiff takes a position that contradicts their own pleading, it can amount to an abuse of process.

The Court emphasized the importance of obeying court orders and warned that those who fail to do so face serious consequences.

The contempt and abuse of process motion is the culmination of many twists and turns in this litigation, which took significant time to unravel and address. It took the entire Litigation team to put together a compelling record of the Plaintiff’s extensive conduct, which ultimately convinced the Court to allow the motion.

Congratulations to the Litigation team for securing a great result!
